Please note registration papers are not released until after timely proof of spay/neuter from veterinarian (hereinafter sometimes referred to as “Vet”) is furnished to Buyer from Seller. In the event that the feline being purchased by Buyer is already spayed/neutered at the “date of sale” (i.e.12/30/25), then Seller agrees to furnish said papers to Buyer at the time of sale or within five (5) business days of the sale date.
The deposit is non-refundable with no exceptions; however, deposit may be applied to a different available feline or a future litter if something unforeseeable happens or if buyer is not able to pay the balance at eight weeks of age for reserved kitten. The security deposit expires two years from this contract date. Pickup is to be not before the feline attains the age of at least eight weeks. After the feline attains the age of eight weeks, a $30 per day fee will be charged and deducted from the deposit. In the event the feline being purchased dies within fourteen (14) days from the date of sale, and the Buyer furnishes Seller with timely proof of same, the sole remedy at that time will either be an exchange/replacement of feline with another feline of similar and/or equal value as the purchased feline (as long as said replacement is available at that time), but will only be agreed upon and offered to Buyer if and only if Buyer furnishes to Seller all rtdocumention from a licensed vet, including but not limited to a complete necropsy report in the case of feline death due to congenital or hereditary defect, and complete medical history report provided by the attending veterinarian, all of which is to be performed at the Buyer’s expense. In the event that, I (Breeder/Seller) choose to have said feline examined by another vet of my choice, Buyer must bring feline to me at Buyer’s expense for said examination, with the second vet opinion to be conducted at Seller’s expense. In the event that the Buyer and Seller are unable to reach a mutual agreement as to the second vet’s opinion, then a third opinion will be conducted by another veterinarian in a different location and/or not in the same clinic, with the costs of said third examination to be equally born by both Seller and Buyer. Seller’s intention is to make every reasonable effort in order to rectify the situation. Buyer has two (2) business days from the time of receiving the feline to have the feline examined by a licensed veterinarian of Buyer’s choosing. If the feline is not examined within said time frame, Buyer waives all warranties and guarantees regarding any congenital and hereditary disorders of feline as well as the Buyer’s rights and remedies put forth in Fla. Stat. § 828.29. Buyer shall have fourteen (14) days from the date of sale to have a Vet of Buyer’s choice examine the feline for any illnesses or diseases and/or the presence of symptoms of a contagious or infectious disease, including the presence of internal or external parasites (excluding fleas and ticks), that , in accordance with and pursuant to Fla. Stat. §828.29(5), would render the feline “unfit" at the time of sale, as defined by said statute.
This examination is only for a second opinion on the general health and status of the kitten; wormed and inoculated as indicated on the shot record which would be a Florida State Health Certificate signed and dated by our long-time veterinarian office feline purchased and not for any other reasons. This warranty does not constitute a right/guarantee to a full refund of the purchase price of the feline, but it does constitute a right/guarantee to a replacement/exchange of the feline for one of similar and/or equivalent value as said feline, as long as one is available at that time. In the event that a feline of similar and/or equivalent value is not available at that time, Seller guarantees Buyer that this right/guarantee shall continue until one becomes available, i.e. until a litter produces a feline of similar and/or equivalent value, so as to make Buyer whole. At my discretion, a replacement feline may be of different color and/or have different parents. I will advise buyer of which felines are available. I will not be liable for transportation or the costs associated with replacement/exchange of a feline as it relates to this scenario; arrangements are made before signing and returning contract. If traveling, travel charges are not included and are at Buyer’s expense.
To the best of my knowledge the feline is in good health at the time of sale and has been physically examined by Dr. Alexandria and/or Dr. Yoleysy Brunet Jimenez on the day of or after the feline is eight weeks, in accordance with and pursuant to all requirements put forth in Fla. Stat. §828.29. Seller agrees to replace/exchange the feline in the event that feline has life-threatening congenital and/or hereditary condition that renders feline “unfit” for sale under the applicable statute, pending Buyer’s timely notification to Seller of same in the manner addressed above. ElleRagdolls’ health guarantee does not include Any form of Cancer, Asthma, Sensitive Digestive Issues, Fluid in lungs, Corona virus, FIP, FIV, Leukemia, bacteria viruses, or any contagious diseases or sickness once the feline is in your care; as we do not have control of who the feline is in contact with. ElleRagdolls makes no guarantee as to show quality, personality, breeding ability, gender, color, coat, bite, eyes, hips, or knees of any kind, nor against any hernias, as most of these typically are due to the dam tugging on the kittens at birth and/or are inherited. No exceptions. Buyer is responsible for all travel and shipping costs for feline returned to Seller’s County of sale for secondary/tertiary examinations, and for receiving replacement/exchange feline.

It is the consumer’s right, pursuant to section 828.29, Florida Statutes, to receive a certificate of veterinary inspection with each dog or cat purchased from a pet dealer. Such certificate shall list all vaccines and deworming medications administered to the animal and shall state that the animal has been examined by a Florida-licensed veterinarian who certifies that, to the best of the veterinarian’s knowledge, the animal was found to have been healthy at the time of the veterinary examination. In the event that the consumer purchases the animal and finds it to have been unfit for purchase as provided in section 828.29(5), Florida Statutes, the consumer must notify the pet dealer within 2 business days of the veterinarian’s determination that the animal was unfit. The consumer has the right to retain, return, or exchange the animal and receive reimbursement for certain related veterinary services rendered to the animal, subject to the right of the dealer to have the animal examined by another veterinarian.
All warranties express herein are subject to change and said warranties/guarantees are valid ONLY for the original owner and are not to be transferred to another party/person.
In the event that the purchased feline is no longer wanted by Buyer and/or needs rehoming, the Seller retains and shall have the right of first refusal. It is never the Seller’s desire for the feline to go to a rescue and/or shelter. Seller will take every reasonable step to attempt to help Buyer in the event that Buyer is either unable to or does not desire to keep your feline at any age, for any reason. In this event, Seller retains the right to re-take possession of the feline and/or to determine a suitable family for the feline to be given to.
This written agreement/Contract constitutes the full and complete agreement between Breeder/Seller and Buyer. All felines that are purchased will be considered sold in Miami Beach, Florida, regardless of the location and/or residence/domicile of the Buyer. The parties to this Contract agree that the venue of any litigation concerning this agreement/Contract shall be deemed proper in Miami-Dade County, Florida and may not be litigated in Buyer’s state and/or country. This agreement constitutes a legal and binding sales contract, and the Buyer and Seller agree that this is a full and complete agreement that exists between the parties, and that all intentions and agreements of the Buyer and Seller are put forth herein. The Buyer and Seller hereby agree that any modifications and/or revisions to this Contract/agreement must be made in writing, and signed and agreed to by both parties, in order for same to be legally enforceable.
The feline that ElleRagdolls is selling to Buyer is in no way or right able to be bred or used for breeding of any kind, as this feline is being sold to Buyer solely as a pet. Buyer understands and takes responsibility that it will spay/neuter the feline on or before the feline’s age of 8 months, and that a failure to do so will be considered untimely in direct contravention of this Contract, and will constitute a breach of this contract. Failure to timely spay/neuter the feline may result in legal action being taken against Buyer, including but not limited to a $1,000 penalty for not honoring this agreement, as well as a penalty/fee of $5,000 per kitten that is illegally bred and sold by Buyer, or the amount each kitten is actually sold for, whichever is greater. In the event Buyer violates this anti-breeding clause, the Seller retains the right to have Buyer return the purchased feline, along with any offspring not yet sold, and Buyer agrees to reimburse Seller for any costs and/or attorneys’ fees expended as a result of having to pursue legal action relating to an alleged violation of this clause, in the event that Seller is successful in said legal action and is deemed the “prevailing party” as a matter of law. ElleRagdolls will withhold pedigree and/or birth certificate in the event that Buyer fails to timey furnish Seller with proof of spay/neuter, as the parties herein agree that this feline is only being purchased as a “pet,” and in no circumstances to be bred. The foregoing clause regarding breeding shall not be applicable to any sale of feline that is already spayed and/or neutered at the time of sale.
If any provision of this Contract or its application to any person or circumstances is held invalid, the invalidity does not affect other provisions or applications of this Contract that can be given effect without the invalid provision or application, and to this end the provisions of this Contract are severable.
