The deposit is non-refundable with no exceptions; however, deposit may be applied to a different available feline or a future litter if something were to happen or if buyer could not pay the balance at four weeks of age for reserved kitten.  Deposit expires two years from this contract date.  Pickup is to be not before eight weeks old. After eight weeks old a $30 per day fee is charged and deducted from the deposit.  Sole remedy is replacement of feline when equal value as replacement and will only be given if all documentation from a licensed vet are produced by buyer including a complete necropsy report in case of feline death due to congenital or hereditary defect, and complete medical history provided by the attending veterinarian performed at the buyer’s expense.  In the event that I (Breeder/Seller) want to have said feline examined by another vet of my choice, buyer must bring feline to me at their expense for examination and second opinion at my expense.  If second opinion is not agreed upon, a third opinion will be chosen in a different location and not in the same clinic.  Every effort will be made to rectify the situation.  Buyer has two business days from the time of receiving the feline to have the feline examined by a licensed veterinarian.  If feline is not examined within this time frame, warranty is null and void.  This examination is only for a second opinion on the general health and status of the kitten; wormed and inoculated as indicated on the shot record which would be a Florida State Health Certificate signed and dated by our long time veterinarian office feline purchased and not for any other reasons.  This warranty is never a money back guarantee but a replacement guarantees only.  At my discretion, a replacement feline may be of different color and/or have different parents.  I will advise buyer of which felines are available.  I will not be liable for transportation, arrangements are made previous to signing and returning contract.  If traveling, travel charges are not included and are at buyer’s expense.

To the best of my knowledge the feline is in good health at the time of sale, and has been physically examined by Dr. Alexandra Valencia in Miami Beach, FL on the day of or after they are eight weeks old per Florida state law.  I will replace feline if it has life-threatening congenital condition such as a heart, liver, kidney disease, etc. or if the feline is not functional as a normal pet within one year of purchase.  I do not guarantee show quality, breeding ability, color, coat, bite, eyes, hips, or knees of any kind, nor against any hernias as most of these are from the dam tugging on them at birth or can be inherited.  No exceptions.  Buyer is responsible for all travel and shipping costs for feline returned and for receiving replacement feline. 

It is the consumer’s right, pursuant to section 828.29, Florida Statutes, to receive a certificate of veterinary inspection with each dog or cat purchased from a pet dealer.  Such certificate shall list all vaccines and deworming medications administered to the animal and shall state that the animal has been examined by a Florida-licensed veterinarian who certifies that, to the best of the veterinarian’s knowledge, the animal was found to have been healthy at the time of the veterinary examination.  In the event that the consumer purchases the animal and finds it to have been unfit for purchase as provided in section 828.29(5), Florida Statutes, the consumer must notify the pet dealer within two business days of the veterinarian’s determination that the animal was unfit.  The consumer has the right to retain, return, or exchange the animal and receive reimbursement for certain related veterinary services rendered to the animal, subject to the right of the dealer to have the animal examined by another veterinarian.

Warranty is subject to change and this guarantee is valid only for the original owner and is not to be transferred to another party/person.  If purchased feline is no longer wanted and needs rehoming the seller shall have right of first refusal.  I never want the feline to go to a rescue/shelter.  I will take steps to help you in the event of you not being able to keep your feline at any age, for any reason.

This constitutes the complete agreement between Breeder/Seller and Buyer.  All felines that are purchased will be considered sold in Miami Beach, Florida regardless of the location of the buyer.  The venue of any litigation concerning the agreement or transaction shall be in Miami Dade County, Florida and may not be litigated in your state or your country.  This is a legal and binding sales contract.
